Temporary legal protection will be provided to the industrial design for which the application has been filed with Rospatent from the date of publication of information on the application until the date of publication of information on the grant of a patent.
This is stated in the law, which entered into force on June 27. Changes have been made to Part 4 of the Civil Code of the Russian Federation. Temporary legal protection of industrial designs is introduced, which is similar in meaning to the temporary legal protection of inventions and implies the possibility of publishing an application for registration of an industrial design at the request of the applicant after the completion of the formal examination.
In addition, the patent owner will be able to receive a cash reward after the registration of the industrial design if the third party used the industrial design filed for registration in the period from the date of publication of the application for registration after passing the examination and until the publication of information on the issuance of the patent. As Pavel Krasheninnikov, Head of the State Duma Committee on State Construction and Legislation, explained earlier, the changes are aimed primarily at supporting the fashion industry and more efficiently protecting the rights of designers who design clothes and shoes and accessories requiring legal protection.
"Now the period of Rospatent state registration of industrial design is 20 months and 2 weeks, which does not contribute to ensuring the rights of designers in a rapidly changing fashion," - said the deputy.
He recalled that the provisional legal protection had previously been granted under the Patent Law of the Russian Federation, which had become invalid more than 10 years ago.
